- Cap on Liability: Our total liability to you for any claims arising out of or relating to these Terms or the Service shall not exceed the total fees paid by you to Commly in the twelve (12) months preceding the claim, except in cases of gross negligence or willful misconduct.

15. Termination
- Termination by You: You may terminate your account at any time by discontinuing use of the Service and following the termination procedures provided.
- Termination by Commly: We reserve the right to suspend or terminate your access to the Service immediately, with or without notice, if you violate these Terms or for any other reason at our sole discretion.
- Effect of Termination: Upon termination, your right to use the Service will cease immediately, and you must promptly delete all materials obtained from the Service. Any obligations incurred prior to termination will survive.
16. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of Spain, without regard to its conflict of law principles. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Madrid, Spain.

Commly shall not be liable for any failure or delay in performing its obligations under these Terms if such failure or delay is caused by circumstances beyond our reasonable control, including but not limited to natural disasters, acts of government, war, or labor disputes.
19. Severability
If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.
20. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Commly regarding your use of the Service and supersede all prior or contemporaneous communications, whether electronic, oral, or written.
